The Department of Upgrading, Housing and Communities is currently consulting on proposals to introduce a new, stricter regulatory regime for high-risk buildings, defined for the purposes of the occupancy phase as an 18m residential building or more height. , or has at least seven storeys.

This briefing note covers consultation on policy proposals for the construction phase of buildings covered by the new regime.

We have published a separate brief covering the consultation on the occupancy regime for occupied high-risk buildings.

The consultation is divided into 12 parts, each part covering a different aspect of the implementation of the new regime for buildings in the construction phase. These include:

  • Skill requirements for all construction work and additional requirements for work on high-risk buildings.
  • A series of “stop points” or sturdy walkways to enhance regulatory oversight before a building is occupied.
  • The regulatory notice approach when a project involves non-high risk and high risk construction work – i.e. informing a local authority that the Building Safety Regulator will oversee all work.
  • Additional requirements for construction work in existing high-risk buildings.
  • Better change control during the construction phase for high-risk buildings.
  • The certification process for construction works that have been carried out without regulatory approval (regularization).
  • Establish an information golden thread – ie a better information management system.
  • A mandatory occurrence reporting system.
  • Stronger enforcement powers and approach to reviewing and appealing building control decisions.
  • Broader changes to bring the existing system in line with the new system.
  • Transitional provisions.

The NHF will submit an industry response to the consultation. To help shape our response, we are seeking members’ views in response to the questions and proposals outlined in our briefing.
